Please read through these terms and conditions carefully before using this website and print a copy for future reference.

We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website and it is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.

Certain website services will require registration and subsequent access to those services will be subject to an approved login name and password ("Password Details"). Information that you provide on this website must be accurate and complete. All Passwords Details are accepted and may be withdrawn at our sole discretion and are exclusive to you and non-transferable and must be treated as strictly confidential at all times. In the event that you have any concerns regarding your Password Details or become aware of any misuse then you must inform us immediately.

 

 

Order Process

  • You can order products from us online via our website. Any order made through our website is subject to these terms and conditions.
  • We automatically send out an email upon receipt of a successful order through our website, this “thank you for your order” email does not guarantee that we have the item in stock and while we make every effort to keep our website updated with stock levels, it is possible that the item will not be in stock. In these very rare cases we will contact you as soon as possible to offer a different product or full refund. Please note that this email is not an order confirmation or order acceptance from us.
  • Acceptance of your order and the completion of the contract between you and us will take place on despatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it.
  • We reserve the right to change or discontinue any item on our website at any time without prior notice.
  • On very rare occasions it may be necessary for us to cancel an order and not send you your purchases, if this happens we will refund you the total value of your order as soon as possible.
  • From time to time we will offer special offers on certain products, all offers are available while stocks last and may be withdrawn at any time without prior notice.

 

Price

  • The prices on our website are inclusive of VAT at 20%. Prices are subject to change and we reserve the right to amend any of our prices at any time without prior notice.
  • While we aim to keep the prices on our website up to date at all times it is possible that prices may occasionally be incorrect. If this happens we may honour the original price offered on our website, however this is completely at our discretion. In some cases the price difference may be such that we will contact you to notify you of the correct price at which point you can either reconfirm your order at the new price and pay the excess or cancel the order and we will issue a full refund. This does not affect your statutory rights.
  • We offer a very simple delivery system and the costs of postage and packing will be made clear to you before submitting any payment details.
  • All of our prices are displayed in Pounds Stirling, any transactions from overseas will be charged at current exchange rates at the time of purchase, we accept no responsibility for or liability arising from exchange rate fluctuations.
  • Some nations will impose import duty on your purchases, please contact your local customs office for details.

 

Payment

  • You can pay via various credit and debit cards as displayed on our website, all orders must be paid for before they are despatched.
  • Payments are processed online using a credit or debit card. We will debit the money from your card as soon as possible following your order.
  • Our payments processing facility is completely secure. Our payments are handled by Protx, who adhere to the most stringent levels of fraud screening. Your card issuer may also carry out security checks when you make a purchase.

 

Delivery

  • We will post to destinations inside and outside of the UK.
  • We have a range of delivery options each with a different cost.
  • Import duties may be payable if we are delivering to an address outside of the UK. WindTrap Limited accepts no responsibility for these duties, please contact your local customs office for information.
  • Please clearly state your delivery address for all non-held items ordered through the website. If you change the delivery address after your items have been despatched you will be charged a re-direction fee.
  • Orders are despatched by Royal Mail, we aim to have your order with you within 5 working days however this can take up to 15, we will not be held accountable for any loss which comes about due to late delivery.
  • We also offer a next day delivery option, this option is available only within the UK. Next day is taken to mean the day following any order which is placed before 3pm on any working day (Saturdays are not included), if an order is placed after 3pm we will endeavour to get your order to you the next day however at peak times it may be posted the following day so allow 2 days for delivery.

  • Please place your order in ample time to receive your goods as we cannot be held responsible for loss or disappointment due to slow delivery of our products.
  • This does not affect your statutory rights as a consumer.

 

Intellectual property

  • You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and/or content made available as part of your use of this website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.
  • You acknowledge and agree that the material and content contained within this website is made available for your personal non-commercial use only and that you may only download such material and content for the purpose of using this website. You further acknowledge that any other use of the material and content of this website is strictly prohibited and you agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

 

Our Responsibilities

  • We have tried to make the images and descriptions within this website as realistic as possible, however we accept no liability for incorrect descriptions or misleading images. No conscious attempt has been made to mislead anybody about any of our products and any such occurrences, although unfortunate are completely accidental and we will not be held responsible for such misunderstandings. If you would like any further information regarding any of our products please contact us.
  • At WindTrap we maintain a high level of service however we cannot be held responsible for any outside courier service or other service provider contracted by us.
  • WindTrap will not be held responsible in any way for an inability to provide our services in the event of major occurrences including but not limited to war, flood, and acts of God.
  • These terms do not affect your statutory rights as a consumer which are available to you.
     

General

  • WindTrap is not involved in the production process of any of the products displayed within this website.
  • These terms apply only to products supplied by WindTrap Ltd, there may be products available to purchase on this site from outside companies who will have their own terms and conditions.
  • This website is aimed at the UK market and therefore we can not guarantee that it applies to local laws in other parts of the world.

 

Returns

  • We at WindTrap are confident that all of our customers will be very happy indeed with their purchases from us, however we realise there may be occasions where you wish to return an item. We have designed our return policy to be as simple as possible; these terms do not affect your statutory rights.
  • Faulty Products - We take every step possible to ensure our goods reach you in perfect condition, however, should an item arrive in a faulty or damaged condition we will replace it free of charge or provide a full refund. In order to receive a refund or replacement the item/s must arrive at the postal address below within 7 days of receipt.
    If you are returning a faulty product, or one which arrived to you in a damaged condition we will refund the postage costs, please obtain proof of postage from your post office so we know how much to refund.
  • Unwanted Products - If you change your mind about a purchase after it has been dispatched please return it to us within 7 days of receipt in an unused state, still in original packaging where applicable and we will happily refund you the price you paid for the order. We can not refund Postage & Packaging costs on orders which are returned simply because they are not wanted. If your order qualified for free postage and you are returning the whole order because it is unwanted we will refund the full cost of the order minus the exact postage costs incurred by us.
    Once we receive your returned item and are happy that it is unused and in good condition (as it was when it was delivered to you) we will refund your payment within 28 days. If you wish to return after this 7 day period then a re-stocking fee will be incurred.
  • We are unable to offer a refund or replacement for any products returned outside of their warrantee period as we would no longer be able to follow up with our suppliers beyond this time.

    How to return your goods
    Contact us by phone on +44 (0)845 567 80 80 with details of the products you wish to return along with your order number/invoice ID as well as your name and address. We will try to contact you within 3 working days with instructions on how to return your item.
    We may supply you with a unique returns code which you should place on the products to help us process the return.
    Please use a secure delivery method to return your items, such as Royal Mail Recorded Delivery which needs to be signed for upon arrival. The items will be your responsibility until they reach us.

Unwanted electrical equipment is the UKs fastest growing type of waste.

Many electrical items can be repaired or recycled, saving natural resources and the environment. If you do not recycle, electrical equipment will end up in landfill where hazardous substances will leak out and cause soil and water contamination – harming wildlife and also human health.

To remind you that old electrical equipment can be recycled, it is now marked with a crossed-out wheeled bin symbol. Please do not throw any electrical equipment (including those marked with the crossed out wheeled bin symbol) in your bin.

Recycle Electronic Goods

What is WEEE?

The Waste Electrical or Electronic Equipment (WEEE) Directive requires countries to maximise separate collection and environmentally friendly processing of these items. In the UK, distributors (including retailers) must provide a system which allows all customers buying new electrical equipment the opportunity to recycle their old items free of charge. Those establishing their own take-back scheme must as a minimum offer all customers buying new electrical equipment free take back of their old electricals on a like-for-like basis.

Liability and indemnity

  • Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under applicable law.
  • We will use reasonable endeavours to verify the accuracy of any information on the site but make no representation or warranty of any kind express or implied statutory or otherwise regarding the contents or availability of the site or that it will be timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the website we will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website and we accept no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the site.

  • This does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights.
  • We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
  • Miscellaneous provisions
  • The contract between us shall be governed by the laws of England and any dispute between us will be resolved exclusively in the courts of England. English is the only language offered for the conclusion of the contract.
  • We have selected our products on the basis that they will be used for domestic use only, if you are planning to use them for business purposes please make sure that you are covered by the appropriate insurance. Where you decide to use the products in the course of a business, we exclude (to the fullest extend permitted by law) those warranties and conditions relating to fitness for a particular purpose. Our maximum liability to business users arising out of or in connection with the products shall be limited to the replacement value of the product in question (except in the case of death or personal injury caused by our negligence or in respect of fraud). In relation to business users, we do not accept liability for the fitness of goods for business purposes, nor do we accept liability for loss of use of the item nor any loss over and above the cost of the item in the event of a claim for breach of warranty or condition.
  • We shall be under no liability for any delay or failure to deliver products or otherwise perform any obligation as specified in these terms and conditions if the same is wholly or partly caused whether directly or indirectly by circumstances beyond its reasonable control.
  • To provide increased value to our customers, we may provide links to other websites or resources for you to access at your sole discretion. You acknowledge and agree that, as you have chosen to enter the linked website we are not responsible for the availability of such external sites or resources, and do not review or endorse and are not responsible or liable, directly or indirectly, for (i) the privacy practices of such websites, (ii) the content of such websites, including (without limitation) any advertising, content, products, goods or other materials or services on or available from such websites or resources or (iii) the use to which others make of these websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, goods or other materials or services available on such external websites or resources.

    A person who is a permitted successor or assignee of the rights or benefits of these terms and conditions may enforce such rights or benefits.
    No consent from the persons is required for the parties to vary or rescind these terms and conditions (whether or not in any way that varies or extinguishes rights or benefits in favour of such third parties).
  • No delay or failure by us to exercise any powers, rights or remedies under these terms and conditions will operate as a waiver of them nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing and signed by our authorised representative.
  • These terms and conditions including the documents or other sources referred to in these terms and conditions supersede all prior representations understandings and agreements between you and us relating to the use of this website (including the order of products) and sets forth the entire agreement and understanding between you and us for your use of this website
